Personal Information Collection Statement (“PICS”)

Chateraise (Hong Kong) Limited (“Chateraise” or “we”, “us” or “our”) recognize the importance of protecting your Personal Data.  This Personal Information Collection Statement (“PICS”) intends to notify you of certain matters regarding our collection of your Personal Data.  Please read this PICS and our Privacy Policy carefully and click the relevant button hereinbelow to indicate your consent to our collection of your Personal Data through this application.  If you do not agree with this PICS or do not want to provide your Personal Data to us, please do not access or use this application.  In addition, if you are under 18 or are incapable of making an informed decision, please obtain the opinion and approval of your parent or guardian in relation to this PICS.

This PICS applies to this application exclusively and does not apply our other websites and services.  Unless otherwise defined hereinbelow or unless the context otherwise provides, any capitalized terms in this PICS shall adopt the same definitions contained in our Privacy Policy.

(1)        Collection of Personal Data

In order to provide you with our products or services, we may collect your Personal Data, including without limitation, your name, mobile number, email address, birth date, address, postal code and other contact information.  Please note that it is mandatory for you to provide the Personal Data marked with asterisks in the relevant forms.  In the event that you do not provide such Personal Data, we may not be able to provide you with our products or services (or any part thereof).

Besides, we may also collect your mobile device information, such as device identification details etc.  We may use cookies on our websites or applications to track website or application visitorship and experience for the purposes of managing and improving the design of the website and/ or application.  Most web browsers are designed to accept cookies.  If you do not wish to receive any cookies, you may set your browser and/ or device to refuse it, but if you do so, you may find that certain features on this application may not function properly.

(2)        Purpose of Collection

We may collect and use your Personal Data for any or all of the following purposes:-

(a)        with your consent, sending marketing information about our goods or services including notifying you of our marketing events, initiatives and promotions, membership and rewards schemes, vouchers and other promotions or campaigns in accordance with the relevant section below;  

(b)        processing and administering your membership registration and, where you have subscribed, mail-magazine registration;

(c)        performing our obligations in the course of or in connection with our provision of any goods and/or services requested by you, including but not limited to delivery of products purchased or giveaway merchandise and usage or redemption of our vouchers, coupons and/or rewards;

(d)        processing payment or credit transactions, if applicable;

(e)        responding to, handling and processing queries, requests, applications, complaints and feedback from you;

(f)        carrying out customer surveys, analysis and market research;

(g)        complying with any applicable laws, regulations, codes of practice, guidelines or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;

(3)        Direct Marketing

Chateraise intends to use your Personal Data for direct marketing in relation to our offers and/ or promotions of our confectionary products and/ or related services.  We will not so use your Personal Data unless we have received your consent or indication of no objection.  

When you consent to our use of your Personal Data for direct marketing, we may use your contact details (email address) for direct marketing purposes and you may from time to time receive from us [emails]containing direct marketing information on offers and/ or promotions in relation to our confectionary products and/ or related services.  

If you do not wish to receive any such direct marketing communications, you can at any time send your request in writing to our Data Protection Officer at the contact details provided below.

(4)        Disclosure and Transfer of Personal Data

We aim to treat your Personal Data with due care and diligence.  However, we may disclose your Personal Data under the following circumstances:

(a)        where such disclosure is necessary for performing obligations in the course of or in connection with our provisions of the goods or services requested by you;

(b)        where such disclosure is required by any applicable laws, regulations, codes of practice, guidelines or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority.

Further, the personal data processing of your Personal Data may be outsourced to a cloud provider in Hong Kong. We will however continue to be ultimately responsible for the protection of the personal data collected and held by them.

(5)        Data Security

To safeguard your Personal Data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, we have, to the extent required by the Ordinance, introduced appropriate administrative, physical and technical measures such as up-to-date antivirus protection, encryption and the use of privacy filters to secure all storage and transmission of Personal Data by us, and disclosing Personal Data both internally and to our franchisees, authorised third party service providers and agents only on a need-to-know basis.

However, you should be aware that no method of transmission over the Internet, applications or method of electronic storage is completely secure.  While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.

(6)        Data access and correction request

Under the Personal Data (Privacy) Ordinance (Cap. 486), you have the right to request access to and correction of your Personal Data held by us.  Data access and correction request may be made to Data Protection Officers in accordance with our Privacy Policy.
